Book IV: General health administration

Up to 50% of the number of elected representatives on the Agency and Working Conditions Committee and at the joint request of the trade unions represented on the Committee, local representatives may be appointed by the Committee, from among its full or alternate members, at each site and branch of a Regional Health Agency.

The trade union organisations send the list of candidates to the chairman and secretary of the Agency and Working Conditions Committee. The Agency and Working Conditions Committee appoints the local representatives. If there is no full or alternate member present on a site or in a branch, staff duly authorised by a representative trade union organisation may be appointed.

The appointment of local representatives is discussed by the Agency and Working Conditions Committee at the first meeting following each election of committee members. If necessary, this discussion is again included on the agenda for the next meeting.

Local representatives benefit from the delegation hours provided for in articles R. 1432-109-1 in accordance with the application procedures defined in articles R. 1432-109-2 to R. 1432-110.

The term of office of the local representative ends at the end of the term of office of the elected members of the Agency and Working Conditions Committee who appointed him or in the cases provided for in Article R. 1432-82. The local representative has a listening role at local level, particularly with regard to working conditions. He receives collective and individual complaints from employees. A meeting is held at least twice a year with all the local representatives of a regional health agency, chaired by the agency’s Director General or his/her representative.

The local representative receives the training in health, safety and working conditions mentioned in Article R. 1432-102-1.
