Part One: General health protection

Chapter I of Title VII of Book II of this Part is applicable to Wallis and Futuna, with the exception of Articles L. 1271-7 and L. 1271-8, and subject to the adaptations provided for in this Chapter. Article L. 1271-2 is applicable in Wallis and Futuna in the version resulting from Law no. 2021-1017 of 2 August 2021.

For its application in Wallis and Futuna, Article L. 1271-1 is replaced by the following provisions: Art.L. 1271-1 – Carrying out blood transfusion-related activities without holding the authorisations provided for in article L. 1221-12 or in breach of the requirements laid down in these authorisations is punishable by two years’ imprisonment and a fine of 75,000 euros.

For its application in Wallis and Futuna, the second paragraph of article L. 1271-5 is replaced by the following provisions: The same penalties shall apply to contravening or attempting to contravene the stipulations of the agreement provided for in article L. 1522-5.

I. – It is punishable by two years’ imprisonment and a fine of 37,500 euros for any person, whether or not a party to the contract, to deceive the contracting party, by any means or process whatsoever, even through the intermediary of a third party: 1° Either about the nature, species, origin, substantial qualities, composition or content in useful principles of human blood, its components or labile products derived therefrom;…

The penalties provided for in article L. 1525-4 are doubled: 1° If the offences provided for in the said article have resulted in the use of the goods being dangerous to human health; 2° If the offence or attempted offence provided for in article L. 1525-5 have been committed: a) Either using false or inaccurate weights, measures and other instruments; b) Or using manoeuvres or procedures designed to distort the…

The following are punishable by the penalties laid down in article L. 1525-4: 1° Falsifying medicinal substances intended for sale; 2° Exhibiting, offering for sale or selling falsified medicinal substances. If the falsified medicinal substance is harmful to human health, the penalties are doubled. These penalties apply even if the harmful falsification is known to the buyer or consumer.

Chapters II, III and IV of Title VII of Book II of this Part are applicable to Wallis and Futuna. Articles L. 1272-2, L. 1272-4 and L. 1273-3 shall apply there in the version resulting from Law no. 2021-1017 of 2 August 2021.

The 1° and 2° of Article L. 1324-3, in the version resulting from Order No. 2017-9 of 5 January 2017, are applicable in the territory of the Wallis and Futuna Islands.

Articles L. 1336-5 to L. 1336-9 of this code are applicable in the territory of the Wallis and Futuna Islands.
