The purchaser may, without prior advertising or competitive tendering, award a contract for supplies or services the estimated value of which is below the formalised procedure threshold and which are necessary for the performance of non-profitable scientific or technical tasks specialising in research, development, study or experimentation, excluding services for the day-to-day running of the service.

Where a contract covers both the provision of services mentioned in article R. 2323-2 and the provision of services not mentioned therein, it shall be awarded in accordance with the rules that apply to whichever of these two categories of services has the higher estimated value.
The provisions of articles R. 2123-4 to R. 2123-6 apply.
The purchaser shall award the contract in accordance with one of the formalised procedures provided for in this chapter where the estimated value of the requirement is equal to or greater than the European thresholds set out in a notice annexed to this Code, subject to the provisions of Chapter II and Section 1 of Chapter III.
If the defence or security contract is awarded using the invitation to tender procedure mentioned in article L. 2124-2, this invitation to tender is restricted. Only candidates selected by the purchaser are thus authorised to submit tenders.
When the purchaser uses the procedure with negotiation for the award of a defence or security contract, he negotiates the terms of the contract only with the economic operator or operators authorised to take part in the negotiations.
The purchaser may, for the award of a defence or security contract, use the competitive dialogue procedure referred to in article L. 2124-4, when at least one of the following conditions is met: 1° The purchaser is objectively unable to define alone and in advance the technical means capable of meeting its needs; 2° The purchaser is objectively unable to establish the legal or financial package for a project.
Purchasers may make known their intention to award a defence or security contract through the publication of a prior information notice.This notice shall be drawn up in accordance with the model set out in the European Commission Regulation establishing standard forms for the publication of notices in the framework of procurement procedures.
