The purchaser shall keep the applications and tenders as well as the documents relating to the award procedure for a minimum period of five years from the date of signature of the contract.
The purchaser shall keep the contract documents for a minimum period of five years for supply or service contracts and ten years for works, project management or technical control contracts as from the end of the performance of the contract.
The purchaser may, at any time, declare a procedure to be discontinued.
When it declares a procedure to have been discontinued, the purchaser shall as soon as possible communicate the reasons for its decision not to award the contract or to recommence the procedure to the economic operators who took part.
The purchasers mentioned in article R. 2100-1 are not subject to the provisions of this chapter, with the exception of those of articles R. 2191-20 and R. 2191-21. However, Pôle Emploi and, for their purchases intended for the conduct of their research activities, the public administrative establishments of the State whose statutes include a research mission are subject to the provisions of sections 1 to 3 of this chapter.
Purchasers not subject to the provisions of this chapter may voluntarily apply them.
The purchaser shall grant an advance payment to the holder of a contract where the initial amount of the contract is greater than 50,000 euros excluding tax and where the performance period is greater than two months.
The purchaser may provide for the payment of an advance in cases where it is not compulsory.
The contractor may refuse payment of the advance.
Where part of the contract is subcontracted, the initial amount of the contract is reduced by the amount of the services entrusted to the subcontractor and giving rise to direct payment.
