The purchaser notifies the contractor of the contract.The contract takes effect on the date of receipt of the notification.
The contracts of local authorities, their groupings and their public establishments take effect on the date of receipt of notification of the contract to the contractor, subject to compliance with the provisions of the General Code of Local Authorities relating to control of legality.
For contracts meeting a need for an amount equal to or greater than the European thresholds set out in a notice annexed to this code, the purchaser shall send for publication, within a maximum period of thirty days from the signing of the contract, an award notice under the following conditions:1° For the State, its public establishments other than of an industrial and commercial nature, local authorities, their public establishments…
The award notice shall be drawn up in accordance with the model set out in the European Commission Regulation establishing standard forms for the publication of notices in the framework of the award of contracts.
For subsequent contracts based on a framework agreement, the purchaser does not need to send an award notice.
For specific contracts based on a dynamic purchasing system and contracts for social services and other specific services, the purchaser may group award notices on a quarterly basis. In this case, he shall send these grouped notices for publication no later than thirty days after the end of each quarter.
Under the conditions laid down in Article L. 2132-1, certain information on the award of the contract may not be published if its disclosure would impede law enforcement, would be contrary to the public interest, would prejudice the legitimate commercial interests of a particular economic operator, whether public or private, or could prejudice fair competition between economic operators.
Where the call for competition was made in the form of a prior information notice or a periodic indicative notice and the purchaser has decided not to award any new contracts during the period covered by the notice, the award notice shall expressly mention this fact.
For research and development service contracts awarded by a contracting entity, the information concerning the nature and quantity of the services may be limited: 1° To the words “research and development services” where the contract was awarded without prior advertising or competitive tendering in accordance with 1° of Article R. 2122-11; 2° To information at least as detailed as that which appeared in the notice used as a call for…
The contracting authority shall draw up a report presenting the procedure for awarding contracts and dynamic purchasing systems meeting a need whose value is equal to or greater than the European thresholds set out in a notice annexed to this Code.This report need not be drawn up for subsequent contracts based on a framework agreement where these are concluded without reopening competition.
