The minimum time limit for receipt of applications shall be thirty-seven days from the date on which the contract notice was sent or thirty days where the notice was sent electronically.Where a situation of urgency not caused by the purchaser makes it impossible to respect this time limit, it may be reduced to fifteen days or ten days where the notice was sent electronically.

The purchaser shall indicate in the consultation documents the minimum requirements with which tenders must comply.

The deadline for receipt of tenders is freely set by the purchaser.

The purchaser shall negotiate with all tenderers in respect of their initial and subsequent tenders, with the exception of final tenders. The negotiations may not relate to the subject of the contract or substantially modify the characteristics and conditions of performance of the contract as defined in the consultation documents. The minimum requirements mentioned in article R. 2361-9 and the award criteria may not be the subject of negotiation.

Negotiation may take place in successive phases so as to reduce the number of tenders to be negotiated by applying the award criteria specified in the contract notice or in another consultation document. The purchaser shall indicate in one of these documents whether it will make use of this possibility.
