Appeals are open to the public prosecutor.
Within fifteen days of the date on which it becomes res judicata, at the request of the public prosecutor, the decision revoking the simple adoption is entered in the margin of the adopted person’s birth certificate. Where the adopted person was born abroad, the decision is transcribed onto the registers of the central civil status department of the Ministry of Foreign Affairs, at the request of the public prosecutor.
The appeal is lodged as in contentious matters. It is investigated and judged according to the rules applicable at first instance.
The adoption decision is enforceable provisionally only if it so orders. The time limit for an appeal in cassation suspends the enforcement of the adoption decision. An appeal in cassation lodged within this time limit also suspends enforcement.
Applications relating to the exercise of parental authority falling within the jurisdiction of the family court shall be formulated, investigated and judged in accordance with the rules laid down in Chapter V of this Title, subject to the provisions of this section.
For the application of Article 373-2-8 and article 373-2-13 of the Civil Code, third parties shall by simple request refer the matter to the public prosecutor, who may obtain any information he or she considers useful about the situation of the minor and his or her family.
Claims made pursuant to article 371-4 and the first paragraph of l’article 373-3 du code civil obey the rules of ordinary written procedure applicable before the judicial court; they are judged after the opinion of the public prosecutor.
The joint declaration provided for in articles 370-1-8 and 372 of the Civil Code shall be delivered or sent in triplicate by registered post to the registrar of the judicial court for the place where the child lives. The order provisionally fixing the child’s residence pursuant to paragraph 2 of Article 373-2-9 of the Civil Code mentions, in addition to the duration of the measure, the place, day and time of the hearing at which a new decision will be taken on the residence.
