PART TWO: THE MUNICIPALITY

The legal regime governing certain communal plots of land over which certain residents have exclusive rights of enjoyment, derogating from ordinary law, may be terminated at any time, regardless of its origin. Where the rights of enjoyment were only of a life nature, they ended on 4 January 1967.

For the purpose of conducting a census of parcels of land mentioned in article L. 2421-1, the mayor of the commune shall draw up, for each of these parcels, a statement : 1° Indicating its cadastral designation, its exact surface area, the surname, first names and domicile of the current holder of the right of enjoyment and the date on which this right was acquired; 2° Specifying whether this right…

This statement, drawn up and stamped by the mayor, is then submitted to the town council for consideration. When the second paragraph of article L. 2421-1 to the legal regime defined in this article, the municipal council shall decide whether to terminate it.

The statement is published and displayed for at least two months. It is notified to the holders of the rights of use mentioned in article L. 2421-2 as well as to persons who lease or who, in good faith, occupy or exploit the parcels over which these rights are exercised.
