Under the conditions laid down in their articles of association, pharmacists belonging to one of the categories of practitioners mentioned in 1° of article L. 6152-1 may manage an internal-use pharmacy in private health establishments providing long-term care and private medico-social establishments mentioned in 3° and 4° of article R. 5126-1.
The pharmacist responsible for managing the in-house pharmacy is appointed by the legal representative of the legal entity concerned.
Where the scale of the pharmacy’s activity so requires, one or more assistant pharmacists shall assist the pharmacist in charge. Where the pharmacy has associate assistants or associate practitioners, this number is taken into account when determining this number.
Assistant pharmacists who are absent for more than one month, for whatever reason, shall be replaced. They shall be replaced in accordance with the statutory provisions applicable to them or the contract between them and their employer.
Assistant pharmacists and the pharmacists who replace them in the internal use pharmacies set up in prisons by virtue of article R. 5126-24 must, in addition, meet the conditions of practice set out in article R. 5126-47.
The provisions of this section apply to the internal use pharmacies of the establishments, services or organisations mentioned in 1° of article R. 5126-1, with the exception of the Institution nationale des invalides. For the purposes of this section, army hospitals are considered to be health establishments.
Where the internal-use pharmacy of a health care institution is authorised to supply medicinal products or health care products to the public pursuant to 1° and 2° of Article L. 5126-6 or Article L. 6111-1-1, the internal-use pharmacy premises must be equipped in such a way as to respect confidentiality and ensure the safety of the staff concerned.
