Book I: Pharmaceutical products

The provisions of this section apply to the establishments, services or organisations defined in Article L. 5126-10.

In the establishments, services or organisations mentioned in I of Article L. 5126-10 which do not have an in-house pharmacy, the medicinal products, products or articles mentioned in Article L. 4211-1 and sterile medical devices may be held and dispensed under the responsibility of a pharmacist managing an in-house pharmacy or a pharmacist holding a dispensary.

The agreements provided for in I and II of article L. 5126-10 are sent for information to the Director General of the regional health agency with territorial jurisdiction over the establishment, service or organisation. In particular, these agreements set out the terms and conditions for supplying, dispensing and holding the medicinal products, products or articles mentioned in article L. 4211-1 and the sterile medical devices concerned.

In addition to the treatments prescribed for a specific person, the establishments, services or organisations mentioned in I of article L. 5126-10 may hold certain medicines, products or objects mentioned in article L. 4211-1 and sterile medical devices, included on a list drawn up by the pharmacist who has entered into an agreement in application of I of article L. 5126-10 and one of the doctors attached to the establishment,…

The medicinal products and products referred to in article R. 5126-108 are held in one or more premises, cupboards or other locked storage devices, or with a locking system that ensures the same security, dedicated to their storage.

I.-For healthcare institutions which do not have an in-house pharmacy, medicinal products reserved for hospital use are supplied either by a pharmaceutical company in application of 8° of article R. 5124-45, or by an in-house pharmacy of a healthcare institution or a health cooperation grouping in accordance with 4° of article L. 5126-5.
