When the thing remains in common between the owners of the materials from which it was formed, it must be licensed for the common benefit.
In all cases where the owner whose material has been used, without his knowledge, to form a thing of another kind may claim ownership of that thing, he has the option of claiming the return of his material in the same kind, quantity, weight, measure and goodness, or its estimated value at the date of the return.
Those who have used materials belonging to others, and without their knowledge, may also be ordered to pay damages, if appropriate, without prejudice to proceedings by extraordinary means, if the case so requires.
Usufruct is the right to enjoy things owned by another, like the owner himself, but with the charge of preserving their substance.
Usufruct is established by law, or by the will of man.
The usufruct may be established, or purely, or on a certain day, or conditionally.
It may be established on any kind of movable or immovable property.
The usufructuary has the right to enjoy any kind of fruit, whether natural, industrial or civil, that the object of which he has usufruct may produce.
Natural fruits are those which are the spontaneous product of the earth. The product and growth of animals are also natural fruits. The industrial fruits of a fund are those obtained by cultivation.
Civil fruits are house rents, interest on sums due, arrears on annuities. Farm lease prices are also classed as civil fruits.
