The provisions of this section shall also apply to contracts concluded between a professional and a non-professional.
The provisions of this section are of public order.
For the purposes of this section, the following definitions shall apply: 1° Electronic communications services means services consisting wholly or mainly in the provision of electronic communications within the meaning of 6° of Article L. 32 of the French Post and Electronic Communications Code; 2° Micro-enterprises and small enterprises means the enterprises defined in the Annex to European Commission Recommendation 2003/361/EC of 6 May 2003; > End-user means a user…
Articles L. 224-28, L. 224-29, L. 224-31, L. 224-33, L. 224-34, L. 224-40, L. 224-42 and L. 224-42-1 do not apply to interpersonal communications services not based on numbering within the meaning of 6° quater of Article L. 32 of the French Post and Electronic Communications Code. Article L. 224-27, the I of article L. 224-28, articles L. 224-29, L. 224-30, L. 224-42 and the I and III of article L. 224-42-2 are also applicable to end users who are micro-enterprises, small businesses or non-profit organisations unless these users have expressly agreed to waive all or part of these provisions. The articles L. 224-26-3, L. 224-33, L. 224-40 and L. 224-42-1 apply to end users.
This section shall not apply to micro-enterprises providing non-dial-based interpersonal communications services, unless they also provide other electronic communications services. Prior to the conclusion of a contract, such undertakings shall inform consumers of this exemption, by means of a clear and unambiguous statement indicating that the contract does not, by virtue of this exemption, benefit from the consumer protection provisions laid down in this Section.
I.-Prior to the conclusion of a contract, providers of publicly available electronic communications services shall communicate to consumers, insofar as it concerns a service they provide: 1° The information mentioned in articles L. 111-1, L. 221-5 and, where applicable, L. 221-8 and L. 221-11 ; 2° The information mentioned in article L. 224-27-1. Prior to the conclusion of a contract, providers of publicly available electronic communications services shall inform end users of the existence of the rights to compensation provided for in Article L. 224-42-1.
Prior to the conclusion of a contract, providers of publicly available Internet access and interpersonal electronic communications services shall communicate, as part of the price information, for a bundled offer of services or a bundled offer of services and terminal equipment, the price of the individual elements of the bundled offer insofar as they are also marketed separately.
