Time spent at meetings of the social and economic committee with the employer by union representatives on the committee is paid as working time. This time is not deducted from delegation hours in companies with at least five hundred and one employees.
In temporary employment undertakings, delegation hours used between two assignments, in accordance with contractual provisions, by a full committee member to carry out his mandate, are considered as working hours. For the purposes of remuneration and social security contributions, these delegation hours are deemed to be attached to the last assignment contract with the temporary employment undertaking for which the full works council member was elected.
In order to carry out their duties, the elected members of the social and economic committee staff delegation and the union representatives on the committee may, during delegation hours, travel outside the company. The members of the staff delegation of the social and economic committee may post the information that they are responsible for bringing to the attention of the staff in places that must be set aside for trade union communications, as well as at the entrances to workplaces.
The time devoted to the training provided for in this chapter is taken from working time and is paid as such. It is not deducted from delegation hours.
The training is provided either by a body appearing on a list drawn up by the administrative authority under conditions determined by decree of the Conseil d’Etat, or by one of the bodies mentioned in Article L. 2145-5. These training courses are renewed when the representatives have exercised their mandate for four consecutive or non-consecutive years.
The members of the staff delegation of the social and economic committee and the contact person provided for in the last paragraph of Article L. 2314-1 receive the training they need to carry out their duties in terms of health, safety and working conditions as provided for in Chapter II of this Title, under conditions determined by decree by the Conseil d’Etat.
