For the application of this Code in the Territory, the terms listed below are replaced as follows: 1° “Tribunal judiciaire” by “tribunal de première instance”; 2° “Tribunal de commerce” or “justice consulaire” by “tribunal mixte de commerce”; 3° “Conseil de prud’hommes” by “tribunal du travail”; 4° “Bulletin officiel des annonces civiles et commerciales” by “Journal officiel de la Nouvelle-Calédonie” ; 5° “Département” or “arrondissement” by “New Caledonia” or by “province”;…

References made, by provisions of the present code applicable in New Caledonia, to other articles of the present code, concern only those articles made applicable in New Caledonia with the adaptations provided for in the chapters below.

In the absence of adaptation, references made by provisions of this code applicable in New Caledonia, to provisions which are not applicable there, are replaced by references to provisions with the same purpose applicable locally.

References made by provisions of the present code applicable in New Caledonia to provisions of the Labour Code, are only applicable there if there is a locally applicable provision with the same purpose.

References to registration in the national register of companies as a company in the trades and crafts sector are replaced by references to registration made in accordance with the regulations applicable in New Caledonia.

Articles referring to the European Community shall apply in compliance with the Association Decision provided for in Article 136 of the Treaty establishing the European Community. References to the Agreement on the European Economic Area shall not apply.
