The subcontractor entitled to direct payment shall send his request for payment to the contract holder, by any means that enables receipt and date to be determined, or deposit it with the contract holder in return for a receipt.
The holder has a period of fifteen days from the date of receipt or the acknowledgement of receipt mentioned in article R. 2193-11 to give his agreement or notify a refusal, on the one hand, to the subcontractor and, on the other hand, to the purchaser.
Once the period referred to in article R. 2193-12 has elapsed, the contractor is deemed to have accepted those supporting documents or parts of supporting documents which he has not expressly accepted or refused.
When the subcontractor has obtained proof or a receipt certifying that the holder has indeed received the request for payment under the conditions set out in article R. 2193-11 or that he has the postal notice certifying that the envelope has been refused or has not been collected by the holder, the subcontractor shall send his request for payment to the purchaser accompanied by this proof, the receipt or the…
The purchaser shall inform the holder of the payments it makes to the subcontractor.
When the subcontractor uses the public invoicing portal mentioned in article L. 2192-5, he submits his request for payment there without any further formality. The contractor has fifteen days from the date of this submission to accept or refuse the request for payment on this portal.
Where the provisions of Sections 1 to 3 of Chapter I of this Title apply to the contract, they shall apply to the subcontractors subject to the specific provisions of this sub-section.
Where part of the contract is subcontracted, the advance paid to the contractor is calculated on the basis of the amount of the contract less, where applicable, the amount of the services entrusted to the subcontractors and giving rise to direct payment.
As soon as the contractor fulfils the conditions to benefit from an advance payment, an advance payment is made, at their request, to the subcontractors benefiting from direct payment. The subcontractor’s right to an advance payment is established as soon as the purchaser notifies the contract or the special act. Repayment of this advance shall be deducted from the sums due to the subcontractor in accordance with the same procedures as those set out in articles R. 2191-11 and R. 2191-12.
