The conceding authority may limit the number of candidates admitted to submit a tender. In this case, it sets, in the consultation documents, a minimum number of candidates admitted to submit a bid and, where appropriate, a maximum number. The number of candidates admitted to submit a bid must guarantee effective competition.
The conceding authority selects the candidates by applying non-discriminatory selection criteria linked to the subject of the concession contract and relating to their capacities and skills. These criteria are mentioned in the consultation documents.
If the number of candidates meeting the criteria for selecting applications is lower than the minimum number indicated in the consultation documents, the concession-granting authority may continue the procedure with the selected candidate or candidates only.
The concession-granting authority shall set the time limit for receipt of applications, depending in particular on the nature, amount and characteristics of the works or services required of the concessionaire.The minimum time limit for receipt of applications, accompanied, where applicable, by tenders, shall be:1° Thirty days from the date on which the concession notice is sent;2° Twenty-five days where the concession-granting authority accepts that applications be sent to it electronically.
Where applications can only be submitted following a visit to the site where the contract is to be performed or after on-site consultation of additional documents, the deadline for receipt of applications shall be set so as to allow the economic operators concerned to familiarise themselves with the information required to submit their applications.
In support of its application, the candidate shall produce a declaration on its honour certifying: 1° That it is not the subject of any exclusion from participation in the procedure for awarding concession contracts provided for in Articles L. 3123-1 to L. 3123-14 ; 2° That the information and documents relating to its capacities and skills, required pursuant to Articles L. 3123-18, L. 3123-19 and L. 3123-21 and under the…
At the latest before the contract is awarded, the candidate must produce any document certifying that it has not been excluded from participating in the procedure for awarding concession contracts provided for in articles L. 3123-1 to L. 3123-14.
To prove that it has fulfilled the obligations set out in article L. 3123-2, the candidate shall produce a certificate issued by the competent administrations and bodies. The list of taxes, levies, contributions or social security contributions for which a certificate must be issued and the list of competent administrations and bodies are set out in an order of the Minister for the Economy appended to this code.
If the candidate relies on the capacities and abilities of other economic operators, it must provide evidence of the capacities and abilities of these economic operators and prove that it will have them throughout the performance of the contract. Before examining the applications, the concession-granting authority which finds that documents or information are missing which must be produced in accordance with the provisions of articles R. 3123-1 to R. 3123-8 and articles R. 3123-16 to R. 3123-19 may ask the applicants concerned to complete their application file within an appropriate period of time.
