The artistic committee invites the selected artists to submit their projects. It may interview them. It proposes one or more of the projects to the buyer.
The purchaser makes his choice, after consulting the artistic committee, in a reasoned decision and informs all the candidates.
Artists who have submitted an unsuccessful project to the Artistic Committee will receive compensation.Total compensation may not exceed 20% of the amount defined in article 2 of decree no. 2002-677 of 29 April 2002 relating to the obligation to decorate public buildings and specifying the conditions for the award of contracts intended to meet this obligation.The purchaser may decide, on the proposal of the Artistic Committee, to cancel or reduce…
The contract for the decoration of public buildings is awarded to one or more living artists after obtaining the opinion of the project manager, the user of the work and the regional director of cultural affairs when it involves the purchase of one or more existing artistic creations and the amount is less than 30,000 euros excluding tax.
Contracts for the decoration of public buildings are awarded under the conditions set out in paragraph 1 of this sub-section when they involve the purchase of one or more existing artistic works and when their value is greater than or equal to 30,000 euros excluding tax and less than the European thresholds mentioned in a notice annexed to this code.
When the contract for the decoration of public buildings concerns the purchase or commission of one or more artistic works and its value exceeds the European thresholds mentioned in a notice annexed to this code, it is awarded in accordance with the rules defined in Titles I to VI and VIII. However, the purchaser is also required to involve an artistic committee in accordance with the provisions of sub-section 3.
For operations located on national territory, the artistic committee mentioned in article R. 2172-9 is made up of the following members: 1° The project owner or his representative, who chairs the committee; 2° The project manager; 3° The regional director of cultural affairs or his representative; 4° A representative of the users of the building; 5° Three people qualified in the field of the plastic arts: a) One qualified person…
For projects located outside France, the artistic committee mentioned in article R. 2172-9 is made up of the following members: 1° The project owner or his representative, who chairs the committee; 2° The ambassador or his representative; 3° The project manager; 4° The director general of artistic creation or his representative; 5° Two people qualified in the field of visual arts, one of whom is appointed by the project owner…
The purchaser may decide to set up an innovation partnership with one or more economic operators who perform the services separately under individual contracts.
The decision referred to in article R. 2172-20 is indicated in the contract notice or in another consultation document.
