When purchasing temporary buildings, buyers may not exclude temporary buildings that have been reconditioned for re-use, provided that their quality and safety levels are equal to those of new buildings of the same type. They shall take into account the energy and environmental impact of the construction throughout its lifetime.
In order to preserve natural resources, tyres purchased by the State, local authorities and their operators shall be retreaded, unless an initial consultation has proved unsuccessful. Tyre purchases for emergency vehicles and military vehicles may be exempted from the obligations set out in this article.
As soon as it has made its choice, the purchaser communicates it to the candidates and tenderers whose applications or tenders have not been selected, in accordance with the conditions laid down by decree in the Conseil d’Etat.

Contracts awarded by the purchasers mentioned in article L. 2191-1 give rise to advance payments, under the conditions laid down by regulation.
The clauses of the contract relating to the rate and conditions of payment of the advance cannot be modified during performance.
Contracts awarded by the purchasers referred to in article L. 2191-1 give rise to payments on account under the conditions laid down by regulation, once the services have begun to be performed. The amount of a payment on account may not exceed the value of the services to which it relates.
All deferred payments are prohibited in contracts awarded by the State, its public establishments, local authorities, their public establishments and their groupings.
