When the concession granting authority uses negotiations to award the concession contract, it is free to organise negotiations with one or more tenderers under conditions laid down by decree in the Conseil d’Etat.Negotiations may not relate to the subject of the concession, the award criteria or the minimum conditions and characteristics set out in the consultation documents.
The awarding authority rejects irregular or inappropriate bids.
A tender is irregular if it does not comply with the minimum conditions and characteristics indicated in the consultation documents.
A bid is unsuitable if it is clearly unable, without substantial modification, to meet the needs and requirements of the concession-granting authority as specified in the consultation documents.
The concession contract is awarded to the bidder who has submitted the best offer with regard to the overall economic advantage for the conceding authority on the basis of several objective, precise criteria linked to the subject of the concession contract or its performance conditions. As soon as it has made its choice, the purchaser communicates it to the candidates and tenderers whose applications or tenders have not been selected, in accordance with the conditions laid down by decree in the Conseil d’Etat.
The conceding authority makes public the choice of the winning bid, under the conditions and subject to the exceptions provided for by regulation.
The specific procurement rules for certain contracts by virtue of their subject matter or whether or not their estimated value excluding tax is below the European threshold set out in the notice annexed to this code are laid down by decree in the Conseil d’Etat.
