The purchaser may only acquire the products, services or work resulting from the research and development phases if they correspond to the performance levels and do not exceed the maximum costs provided for in the innovation partnership.
For the construction of works resulting from projects selected by the State as part of a national public research, testing and experimentation programme, the purchaser may award project management or works contracts for some of these works in order to verify their relevance.
These contracts are concluded following a competitive tendering procedure in accordance with the provisions of this book, limited to economic operators chosen from among those whose projects have been selected by the jury of the national public programme, after publication of a contract notice. An experimental protocol is signed between the purchaser and the public body responsible for the national programme.
The purchaser shall immediately notify each candidate or tenderer concerned of its decision to reject their application or tender.
Any candidate or tenderer whose application or tender has been rejected may obtain the reasons for this rejection within a period of fifteen days from receipt of its request to the purchaser.Where the tender of this tenderer was neither inappropriate, irregular nor unacceptable, the purchaser shall also inform it of the characteristics and advantages of the tender selected and the name of the successful tenderer.
The notification provided for in article R. 2181-1 shall state the reasons for the rejection of the application or tender. Where the contracting entity decides to reject an application for qualification, it shall inform the economic operator of the reasons for its decision, within a maximum period of fifteen days from the date of that decision. These reasons must be based on the qualification criteria mentioned in Article R. 2162-30.
For contracts awarded in accordance with a formalised procedure, a minimum period of eleven days must be observed between the date on which the notification provided for in articles R. 2181-1 and R. 2181-3 is sent and the date on which the contract is signed by the purchaser.
