Under the terms of an agreement entered into with the State, the French National Olympic and Sports Committee may receive financial and personnel assistance to carry out its missions.
Referral to the committee for conciliation is an obligatory prerequisite to any contentious appeal, when the dispute arises from a decision, whether or not subject to internal appeal, taken by a federation in the exercise of public prerogatives or pursuant to its articles of association.
Where the dispute arises from an individual decision, the enforcement of that decision is suspended from the date of notification to the author of the decision of the document appointing a conciliator. The contentious appeal period applicable to the decisions mentioned in article R. 141-5 and falling within the jurisdiction of the administrative courts is one month.
The Conciliators’ Conference, instituted by article L. 141-4, is made up of a minimum of thirteen members and a maximum of twenty-one members, recognised for their knowledge of the organisation of sporting activities and their expertise in legal matters. These persons are appointed for the duration of the Olympiad by the Board of Directors of the French National Olympic and Sports Committee on the recommendation of its Ethics Committee.
The duties of the conciliators are carried out on a voluntary basis. However, travel and subsistence expenses incurred by conciliators shall be reimbursed by the French National Olympic and Sports Committee upon presentation of supporting documents.
Meeting on the initiative of the oldest member, the Conciliators’ Conference chooses a Chairman and a Vice-Chairman from among its members to assist it.
