Within the meaning of article L. 312-2, a sports facility is any immovable property belonging to a public or private person, specially fitted out or used, on a permanent or temporary basis, with a view to practising sport and open to users, whether free of charge or in return for payment.

Any owner of a sports facility must declare it to the Prefect of the département in which the facility is located within three months of it being brought into service.
