A failure by the lender to comply with the formalities prescribed in articles L. 312-28 and L. 312-29 is punishable by the fine laid down for 5th class offences.
A failure by the lender to comply with the formalities prescribed in article L. 312-32 is punishable by the fine laid down for 5th class offences.
The fact that an advertiser distributes or causes to be distributed advertising that does not comply with the obligations set out in the provisions of article L. 312-41 is punishable by a fine for a 5th class offence.
A seller who fails to comply with the formalities prescribed in article L. 312-42 is punishable by the fine laid down for 5th class offences.
A failure by the lender to comply with the formalities prescribed in article L. 312-43 is punishable by the fine laid down for 5th class offences.
If the seller or service provider fails to specify in the contract, in disregard of the provisions of article L. 312-45, that payment of the price is made using credit is punishable by the fine laid down for 5th class offences.
The fact that the seller or service provider himself or through an agent acting on his behalf has the buyer subscribe to a request for immediate delivery or supply, in disregard of the provisions of article R. 312-20, is punishable by the fine laid down for 3rd class offences.
If the advertiser disseminates or causes to be disseminated advertising that does not comply with the obligations laid down in the provisions of articles L. 312-58, L. 312-59 and L. 312-61 is punishable by the fine laid down for 5th class offences. The court may also order publication of the judgment and rectification of the advertising at the expense of the convicted person.
A creditor or credit intermediary who contravenes the obligations laid down by the provisions of articles L. 312-62 and L. 312-63 with regard to pre-contractual information is punishable by a 5th class fine.
If the lender delivers a contract that does not comply with the provisions of articles L. 312-64 and L. 312-65 is punishable by the fine laid down for 5th class offences.
