Where the analyses or tests carried out on the sample have established that it does not comply with the regulations, the price of the samples paid by the administrative service shall be reimbursed to it by the person from whom the goods were ordered, without prejudice to the penalty provided for in Article L. 531-6.
Any sampling shall include at least three samples, except in the cases provided for in articles R. 512-18 to R. 512-24. One is sent to the State laboratory for analysis, the other two may be sent to the experts appointed under the conditions defined in articles L. 512-42 à L. 512-49.
Sampling shall be carried out in two samples where, because of their value, nature, the insufficient quantity available, the weight or volume of the goods or of the samples intended for analysis or testing, the goods cannot be sampled in three samples.
The sample shall comprise a single sample relating to all or part of the goods where the goods are rapidly deteriorable. A receipt given to the owner or holder of the goods under the conditions set out in article R. 512-14 mentions the quantity rendered unusable.
When, due to its value, its nature or the insufficient quantity of product, the goods cannot be sampled in several samples but only in one sample, and the counter-expertise can be carried out on this sample, it shall be placed in its entirety under seal. As far as microbiological testing is concerned, only one sample is taken.The sample is kept and sent to the competent State laboratory for microbiological research under conditions, in particular temperature, that ensure its preservation.
The samples taken as part of the checks provided for in article L. 511-14 include a sample consisting of one or more units of the product depending on the requirements of the analyses or tests. A report is drawn up in accordance with the conditions laid down in articles R. 512-10 and R. 512-11. This sample is provided with a label bearing the information defined in article R. 512-13.
