The decision of the President of the Centre national du cinéma et de l’image animée specifies the amount of aid awarded and the terms of payment.
The granting of exceptional aid is subject to the provisions of Commission Regulation (EU) No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty, in particular those provided for in Chapter I and Article 54 of Section 11 relating to aid schemes for audiovisual works.
In order to take account of the difficulties of investment linked to the deteriorated conditions in which cinematographic works are shown in cinemas and to encourage the distribution of new works, sums are exceptionally entered into the automatic account of distribution companies.
For each distribution company, the amount of the sums entered on an exceptional basis is equivalent to the amount of the sums entered on its automatic account which lapsed on 31 December 2021 pursuant to 2° of article 123-8, excluding those which benefited from the extension provided for in article 916-12.
Distribution companies may only invest the sums exceptionally entered in their automatic accounts until 31 December 2022. Failing this, the distribution companies will lose their right to invest them.
The period for calculating the sums entered in the automatic account provided for in the second paragraph of article 222-3 is extended by one year for cinematographic works for which this period has expired in 2021 and which have been shown in cinemas after this expiry during the same year.
For cinematographic works shown in cinemas in 2021:1° By way of derogation from 4° of article 222-19, the maximum number of cinemas is increased to two hundred and fifty;2° By way of derogation from 5° of the same article, the minimum amount of final distribution expenditure is reduced to €30,000;3° By way of derogation from the first paragraph of 2° of article 222-20, distribution companies may submit their file to…
