The provisions of articles 707-2 and 707-3 are also applicable to a convicted offender who has been authorised to pay the fine in several instalments spread over time, according to the deadlines and procedures determined by the relevant departments of the Public Treasury.

If a committal or arrest warrant is issued, custodial sentences may be immediately adjusted, under the conditions set out in this Code, without waiting for the sentence to become enforceable pursuant to Article 707, subject to the Public Prosecutor’s right of suspensive appeal provided for in article 712-14.

The amount of the increase in fines provided for in Article 132-20 of the Penal Code is set by the judge on the basis of the circumstances of the offence, the personality of the offender and the offender’s material, family and social circumstances. When a sentence of imprisonment is to be served on a woman who is more than twelve weeks pregnant, the public prosecutor or the sentence enforcement judge shall make every effort either to defer the sentence or to ensure that it is served in an open environment.

The public prosecutor and the public prosecutor shall have the right to directly request the assistance of the public force for the purpose of ensuring such enforcement.

In each judicial court and in each court of appeal, an office for the enforcement of sentences shall be set up, the composition, tasks and operating procedures of which shall be specified by decree.
