When the director of the establishment makes his decision subject to a ban on the practitioner carrying out a lucrative private activity within a maximum radius of ten kilometres of the public health establishment in which he is mainly practising, in application of II of article L. 6152-5-1, this decision is taken after consulting the establishment’s medical committee.

The director of the establishment may exempt a practitioner from participating in continuity of care or pharmaceutical duty under conditions defined by order of the Minister for Health.

Hospital practitioners governed by this section must take part in the juries for competitions and examinations organised by the Ministry of Health or under its supervision and, under the conditions defined by the Ministry of Health, in the teaching and training of staff in hospitals or non-hospital organisations in the sector. These activities give rise to the payment of allowances for participation in competitive examinations, teaching and staff training.

Hospital practitioners may, with the agreement of the director of the health establishment, on the proposal of the head of department or, failing that, the head of the internal structure and after consultation with the head of the department, carry out activities outside the establishment to which they are assigned, up to a limit of: 1° A maximum of two half-days per week on average over the four-month period for…

Hospital practitioners working full-time may carry out the expert assessments mentioned in II of article L. 6152-4 during their working hours, up to a limit of two half-days per week, calculated as an average over a period of four months.

Hospital practitioners are replaced during their leave or occasional absences by practitioners in the same discipline practising in the same health establishment in accordance with the rules laid down by the establishment’s internal regulations.

Hospital practitioners are entitled to the reimbursement of expenses incurred in connection with their temporary travel for service purposes or, without prejudice to the provisions of article R. 6152-72 for hospital practitioners practising in the overseas departments, Mayotte, Saint-Barthélemy, Saint-Martin and Saint-Pierre-et-Miquelon, their changes of residence, in accordance with the provisions applicable to civil servants, subject to the adaptations made necessary by the particular conditions in which they carry out…
