Book I: Health establishments

The Comité national de l’organisation sanitaire et sociale comprises a health section and a social section. It meets in plenary session, at the request of the ministers responsible for social action, health and social security or one of them, when the nature of the issues on the agenda makes it desirable for them to be examined by the whole National Committee.

The Health Section of the Committee is consulted by the Minister for Health on : 1° Draft decrees relating to the conditions for setting up healthcare activities and heavy equipment, issued by virtue of Article L. 6123-1; 2° Draft decrees relating to technical operating conditions adopted by virtue of article L. 6124-1; 3° (Repealed) 4° Appeals to the Minister in application of article L. 6122-10-1 ; 5° Draft decrees creating…

The Committee is chaired either by a Councillor of State appointed by the Ministers for Social Action, Health and Social Security on the recommendation of the Vice-President of the Council of State, or by a Senior Advisor to the Court of Auditors appointed by the same Ministers on the recommendation of the First President of the Court of Auditors. The Committee may invite any person whose assistance it considers desirable to take part in its work, in a temporary advisory capacity.

The powers and composition of the Committee’s social section are set out in Articles R. 312-177 and R. 312-178 of the French Social Action and Family Code. Unless otherwise stipulated, the operating procedures of the health section apply to the social section.

I.-The list of organisations, institutions, groups or trade unions represented in each section of the Committee and the number of seats they have are determined by order of the ministers responsible for social action, health and social security, for a period of five years. The National Committee meets as a section or in plenary session, when convened by the minister(s) responsible for social action, health and social security. The secretariat is provided by the departments of the aforementioned ministers.
