Where applicable, the court clerk shall notify the pursuing creditors that they may inspect the report referred to in the second paragraph of article R. 621-3 at the court clerk’s office and at the same time notify them of the date of the hearing.
For the application of article R. 621-11, the number of employees to be taken into account is assessed on the date of the request or, in the event of an ex officio referral, on the date the debtor is summoned.
For the application of article R. 621-4, if the judgment cannot be rendered immediately, the date of its pronouncement is communicated to the debtor and, where applicable, to the pursuing creditor.
Where it appears that the debtor does not meet the conditions required for the opening of receivership proceedings, the court shall reject the application.
The judgment ruling on the opening of the proceedings is notified to the debtor or the creditor, where he is the claimant, by the registrar within eight days of its pronouncement. Where the debtor is not the claimant, the judgment shall be served on him within the same period.
The decision by which the court modifies the date of cessation of payments is notified to the debtor, communicated to the persons mentioned in article R. 621-7 and is advertised as provided for in article R. 621-8.
At their request, the director shall deliver to the persons whose shares representing their corporate rights are transferred to the special account provided for in Article L. 631-10 a certificate allowing them to attend company meetings. The amount of the sums for the security of which the protective measure is ordered may not exceed the amount of the damages claimed as compensation for the loss caused by the fault invoked.
The remuneration or subsidies provided for in article L. 631-11 shall be set by the official receiver by specially reasoned decision, the administrator, the judicial representative and the individual debtor or the manager being heard or duly summoned.
Articles R. 621-10 to R. 621-25, excluding the first paragraph of article R. 621-23 and article R. 621-20, are applicable to receivership proceedings.
