The application for family reunification shall include a list of all the family members designated in Articles L. 434-2, L. 434-3 and L. 434-4.
If only partial reunification is requested, the application must include, in addition to the information mentioned in articles R. 434-8 and R. 434-9:1° A statement of the reasons, relating in particular to the health or schooling of the child(ren) or to the family’s housing conditions, which justify, with regard to the interests of the child(ren), that family reunification is not requested for the whole family;2° A list of those family…
A foreign national applying for family reunification shall submit supporting documents in support of their application, the list of which is set by order annexed to this code.
On receipt of a complete application for family reunification, the Office français de l’immigration et de l’intégration (French Office for Immigration and Integration) will immediately issue a certificate stating that the application has been lodged, which will start the six-month period within which the administrative authority must make a decision.
After checking the documents in the family reunification application file and issuing the interested party with a certificate stating that their application has been submitted, the services of the Office français de l’immigration et de l’intégration will send a copy of the file to the mayor of the foreign national’s commune of residence or to the mayor of the commune where the foreign national plans to settle.
The diplomatic or consular authority in whose district the applicant’s family lives is immediately informed of the submission of the application for family reunification by the services of the French Office for Immigration and Integration and, as soon as the application for a long-stay visa is submitted, immediately carries out any checks of foreign civil status records that are requested of it.
The mayor has two months from receipt of the application to check whether the income and housing conditions set out in 1° and 2° of article L. 434-7 have been met. He has an equal period, if the matter has been referred to him for this purpose by the Prefect or, in Paris, by the Police Prefect, to issue an opinion the respect for the essential principles governing family life…
To proceed with the verification of the resource conditions mentioned in article R. 434-4, the mayor examines the supporting documents mentioned in article R. 434-11.
The mayor and the Office français de l’immigration et de l’intégration may, if necessary, refer the matter to the competent regional directorate for business, competition, consumer affairs, labour and employment with a request for an investigation into the employment that provides the applicant for family reunification with all or part of the resources he or she claims.
To proceed with the verification of the housing conditions mentioned in article R. 434-5, the mayor shall examine the supporting documents mentioned in article R. 434-11.
