In conjunction with the occupational physician, the employer shall adapt the preventive measures provided for in this chapter to the needs of workers who are particularly sensitive to the risks arising from exposure to vibration.
Where, despite the measures implemented in application of this chapter, the exposure limit values have been exceeded, the employer: 1° Shall immediately take measures to reduce exposure below the exposure limit values; 2° Shall determine the reasons why the exposure limit values were exceeded and shall adapt the protection and prevention measures in order to prevent them being exceeded again.
When a worker is suffering from an identifiable illness or condition considered by the occupational physician to be the result of exposure to mechanical vibrations in the workplace, the physician will inform the worker of the results and interpretation of the medical examinations he has undergone.
The employer is informed by the occupational physician of any significant findings resulting in particular from the monitoring of the employee’s state of health carried out by the health professional mentioned in the first paragraph of article L. 4624-1, in compliance with medical confidentiality. The occupational physician will determine the relevance and nature of any examinations that may be necessary for workers who have undergone exposure similar to that of a worker suffering from a disease or condition likely to result from exposure to vibration.
