The agreement referred to in article R. 4644-2 may not include clauses authorising the registered occupational risk prevention practitioner to perform procedures falling within the remit of the occupational physician.
The registered occupational risk prevention adviser has access to all non-nominative documents required by this part. This right of access is exercised under conditions which guarantee the confidential nature of the data and the protection of the information referred to in Article R. 4624-9.

The Regional Director of Companies, Competition, Consumption, Labour and Employment registers the occupational risk prevention representative within one month of the date of receipt of the application.
The registration of occupational risk prevention professionals is renewed after a period of five years. It is valid for the whole of France.
The Regional Director of Companies, Competition, Consumption, Labour and Employment may terminate the registration of a professional risk prevention adviser at any time if the adviser does not have the necessary skills, does not comply with legal requirements or is no longer able to carry out his duties.
The occupational risk prevention adviser provides the Regional Director for Business, Competition, Consumer Affairs, Labour and Employment with the information needed to justify his activity.
A person from a Member State of the European Union who is not established in France may occasionally provide occupational risk prevention services if he can prove that he has equivalent skills or qualifications in his country of origin.
The employer shall post, in premises normally accessible to workers, the address and telephone number of: 1° The occupational physician or occupational health service responsible for the establishment; 2° The emergency services; 3° The competent labour inspectorate and the name of the inspector responsible.
Certificates, instructions, results and reports relating to checks and inspections for which the employer is responsible in terms of health and safety at work must be dated. They shall mention the identity of the person or body responsible for the inspection or verification and that of the person who carried out the inspection or verification.
