The employer shall subdivide the areas in which explosive atmospheres may occur into zones and shall ensure that the minimum requirements for the protection of workers are applied in these areas. Joint decrees by the Ministers of Labour and Agriculture determine the rules for classifying areas and the minimum requirements mentioned in the first paragraph.
Entrances to places where explosive atmospheres may occur in quantities likely to present a risk to the health and safety of workers are signposted in accordance with the provisions of the order relating to health and safety signs at work provided for in article R. 4224-24.
The employer shall draw up and update a document relating to explosion protection, as part of the single risk assessment document. Where workers from several undertakings are present in the same workplace, the head of the user undertaking shall specify in the explosion protection document the purpose, measures and procedures for implementing the general coordination of prevention measures which is his responsibility in accordance with the provisions of articles R. 4511-5 to R. 4511-8.
The explosion protection document is drawn up before work begins and is revised when significant changes, extensions or alterations are made, particularly to the premises, work equipment or work organisation.
The Regional Director for Business, Competition, Consumer Affairs, Labour and Employment may grant an establishment a temporary or permanent exemption from some of the requirements laid down in this chapter, on the basis of a proposal for compensatory measures ensuring a level of safety deemed equivalent, when it is recognised that it is practically impossible to apply one of these requirements.
Exemption is granted after investigation by the Labour Inspectorate. It is granted after obtaining the opinion of: 1° The social and economic committee; 2° The departmental consultative committee on safety and accessibility for establishments open to the public.
A decision by the Regional Director of Business, Competition, Consumer Affairs, Labour and Employment will be deemed to have been rejected if the competent Minister to whom the matter is referred remains silent for more than four months in the event of a hierarchical appeal.
The employer shall provide workers with the means to ensure their personal cleanliness, in particular changing rooms, washbasins, toilets and, where appropriate, showers.
Collective changing rooms and washbasins must be installed in a special room with a suitable surface area, isolated from the work and storage rooms and located close to the workers’ passageways.
