Toilets and urinals are installed near rooms intended for accommodation under the conditions set out in Articles R. 4228-11 et seq.
Temperature-controlled showers are installed near the accommodation rooms, in individual cubicles, with one cubicle for every six people.
The provisions of articles R. 4228-26 to R. 4228-35 are not applicable in agricultural establishments, where the provisions relating to workers’ accommodation are set out in Book VII of the Rural and Maritime Fishing Code.
The provisions relating to workers’ accommodation also apply to installations set up outside the boundaries of establishments or sites. The Labour Inspectorate is responsible for monitoring the installation and interior layout of the premises.
In order to implement the injunction provided for in Article L. 4231-1, the inspecting officer shall assess, in particular, the obvious dilapidation of the premises or collective accommodation facilities, their cleanliness, size, number or equipment.
Upon receipt of the injunction, the employer shall inform the project owner or client within twenty-four hours of the measures taken to put an end to the situation. The project owner or client will immediately forward this response to the enforcement officer who issued the warning or will inform the latter of the absence of a response as soon as the period mentioned in the previous paragraph has expired.
If the employer does not effectively regularise the situation, the project owner or client must immediately pay for the collective accommodation of the employees in premises fitted out in accordance with the provisions of articles R. 4228-26 to R. 4228-37.
The injunctions and information referred to in articles R. 4231-1 and R. 4231-2 shall be issued by any means capable of giving them a date certain.
Any work equipment or means of protection which has not actually been used in a Member State of the European Community and which is exhibited, offered for sale, sold, imported, hired out, made available or transferred for any purpose whatsoever is considered to be “placed on the market for the first time”, “new” or “as new”.
