The approval of the public house provided for in article L. 4153-6 is issued to the operator by the Prefect, for a renewable period of five years, after verification that the conditions under which the young worker is accommodated are such as to ensure his health, safety and physical or moral integrity. The Prefect obtains the opinion of the Departmental Director of Health and Social Affairs.
If an application for authorisation remains unanswered for more than two months, it will be deemed to have been rejected.
At the end of the five-year period, the approved operator submits a new application for approval, which is examined under the same conditions as the first application.
If the operator of the public house changes, the application for approval must be renewed.
The Prefect may withdraw or suspend the authorisation if the conditions required for the care of the minor are no longer such as to ensure his or her health, safety and physical or moral integrity.
For the application of the provisions of this chapter, the employer shall, at the request of the Labour Inspectorate, provide proof of the date of birth of each worker under the age of eighteen whom he employs.
The Labour Inspector’s decision to expel a young worker aged fifteen or over from the establishment, in application of article L. 4153-4, is taken on the recommendation of the Labour Inspector or a doctor appointed by the Labour Inspector and, if the parents so request, after an examination of both parties.
The provisions of this section define the work prohibited to young people aged at least fifteen and under eighteen pursuant to Article L. 4153-8 and, subject to the provisions of Article D. 4153-21, the prohibited work which may be exempted pursuant to Article L. 4153-9.
It is forbidden to assign young people to work that exposes them to acts or representations of a pornographic or violent nature.
I.-It is prohibited to assign young people to work involving the preparation, use, handling or exposure to hazardous chemical agents defined in articles R. 4412-3 and R. 4412-60, with the exception of hazardous chemical agents which fall solely within one or more of the hazard categories defined in sections 2.4, 2.13, 2.14 and parts 4 and 5 of Annex I to Regulation (EC) No 1272/2008.
