Thirty days after publication and notification of the decree, the mayor may have the materials of the monuments and funerary emblems remaining on the plot removed. He shall have the remains of the interred persons exhumed. For each plot, these remains are placed in an appropriately sized coffin.
The land occupied by the concessions taken over may be the subject of a new concession contract only when the requirements of articles L. 2223-4, R. 2223-6, R. 2223-19 and R. 2223-20 have been observed.
The articles L. 2223-4, R. 2223-12 to R. 2223-21 do not derogate from the provisions governing military burials. When a person whose death certificate bears the entry “Died for France” duly recorded has been buried in a perpetual or centenary plot, the plot may not be repossessed before the expiry of a period of fifty years from the date of burial. A centenary or perpetual plot may not be repossessed if the municipality or a public institution is obliged to maintain it in execution of a duly accepted donation or testamentary disposition.
If the cemetery site is moved, the plot holders are entitled to obtain a plot with identical characteristics in the new cemetery site.
When granted, spaces for the deposit or interment of urns in the cinerary site are subject to the provisions of articles R. 2223-11 to R. 2223-23. However, when the plot is taken over, the urn is placed in the communal ossuary or the ashes are scattered in the space provided for this purpose. .
Authorisation to remove an urn from a plot at a cemetery site is granted by the mayor under the conditions defined in Article R. 2213-40. In cinerary sites not subject to concessions, the deposit and removal of an urn from a plot are subject to prior declaration to the mayor of the municipality in which the cinerary site is located. .
Managers of cinerary sites ensure that no documents of a commercial nature are visible, with the exception of the prices of their services.
The national funeral regulations provided for in Article L. 2223-20 is made up of the provisions of articles R. 2223-24 to R. 2223-33, R. 2223-40 to R. 2223-55-1, R. 2223-67 to R. 2223-72, R. 2223-75 to R. 2223-79, R. 2223-88 to R. 2223-95 and R. 2223-132.
