The case is referred to the Disciplinary Board by the Director General of the Centre National de Gestion. The practitioner concerned must be notified at least two months in advance, by registered letter with acknowledgement of receipt, of the date of his appearance before the Disciplinary Board and be given full access to his file. The Disciplinary Board must reach a decision within four months of the date on which the matter was referred to it, this period being extended to six months if an additional investigation is carried out. In the event of proceedings before a criminal court, the Disciplinary Board may defer issuing its opinion until the decision of that court.

In the interests of the service, a practitioner who is the subject of disciplinary proceedings may be immediately suspended by the Director General of the Centre national de gestion des praticiens hospitaliers et des personnels de direction de la fonction publique hospitalière.
