The provisions of this sub-section define the declaration procedures required, pursuant to article L. 1333-8, for the nuclear activities mentioned in articles R. 1333-109 and R. 1333-110.

Following the generic review referred to in Article R. 1333-135, the Nuclear Safety Authority may decide that a nuclear activity falls under the declaration regime when the general requirements it has imposed for the performance of this activity are complied with.

After checking that the declaration submitted by the natural or legal person responsible for the nuclear activity is in order and complete, the Nuclear Safety Authority issues a receipt for the declaration.

The decision to reclassify the registration application as an authorisation application, as provided for in IV of Article L. 1333-8, may be made within four months of the date of receipt of the registration application.
The Nuclear Safety Authority will give its decision within six months. If there is no response within this period, the nuclear activity will be registered.
Registration is notified to the natural or legal person responsible for the nuclear activity and is not transferable. The registration decision includes, where appropriate, any adjustments requested by the person responsible for the nuclear activity. When such adjustments are requested, the Nuclear Safety Authority informs the applicant of the draft decision and allows the applicant a period of time in which to submit comments.
