The secretariat of the Medical Risks Observatory is provided by the Office national d’indemnisation des accidents médicaux, des affections iatrogènes et des infections nosocomiales. The operating costs of the Observatory are borne by the Office.
The Medical Risks Observatory may only deliberate if at least half of its members in office, including the Chairman or, in his absence, the Vice-Chairman, are present. Decisions are taken by a majority of the members present. In the event of a tie, the Chairman or, in his absence, the Vice-Chairman, shall have the casting vote. The Medical Risks Observatory may hear any qualified person.
In the interests of public health, the Medical Risks Observatory analyses the data defined in the first paragraph of article L. 1142-29 for the purposes of understanding medical risks, as part of its annual report. The Medical Risks Observatory adopts its own rules of procedure, which set out the conditions under which it operates.
The members of the Medical Risks Observatory and the persons who take part in its work are subject to the obligations set out in article L. 1451-1.
