References made by provisions of the present code applicable in New Caledonia to provisions of the Labour Code are only applicable there if there is a locally applicable provision with the same purpose.
References made by provisions of the present code applicable in New Caledonia to provisions relating to civil procedure are applicable there only if there is a locally applicable provision having the same object. .
References to registration with the Trades Register and the National Business Register as a business in the trades and crafts sector are replaced by references to registration made in accordance with the regulations applicable in New Caledonia. .
Articles referring to the European Community shall apply in compliance with the Association Decision provided for in Article 187 of the Treaty establishing the European Community. References to the Agreement on the European Economic Area shall not apply.
In article R. 121-5, the words: “du I de l’article L. 121-4” are replaced by the words: “de l’article L. 121-4”.
In the second paragraph of Article R. 123-80, after the words: “in article R. 123-166”, the words: “with the exception of the deeds and documents mentioned in articles R. 123-103 to R. 123-117, and in article L. 123-9” are added.
For the application of articles R. 123-103 to R. 123-117, the deeds and documents mentioned in these articles are communicated by the registrars under the conditions set out in article R. 123-150.
In articles R. 232-6, R. 232-7, R. 234-2, R. 234-3, R. 234-5 and R. 234-6, the words: “to the works council” are replaced by the words: “to the employee delegates”.
Article R. 330-1 is worded as follows: “The content of the document mentioned in the second paragraph of Article L. 330-3 is set by an order of the State representative. “
For the application of articles R. 450-1 and R. 450-2 to New Caledonia, the reference to the agents mentioned in article L. 450-1 is replaced by the reference to the sworn agents of New Caledonia mentioned in article 86 of organic law no. 99-209 of 19 March 1999 relating to New Caledonia.
