For the application of article R. 723-24, after the words: “within whose jurisdiction the seat of the commercial court is located”, the words: “which makes the final decision” are inserted.
The acts listed in tables 2 to 6 of the Annex 7-5 of Book VII give rise to the collection of a fee for services rendered by the revenue office set up at the registry of the Noumea court of first instance at the rates and under the conditions defined in these tables and by articles R. 743-140 à R. 743-157.
For the application in New Caledonia of Title II of Book VIII, the references to the “commission régionale d’inscription”, the “chambre régionale de discipline” and the “chambre régionale des comptes” are replaced, respectively, by the references to the “commission territoriale d’inscription”, the “chambre territoriale de discipline” and the “chambre territoriale des comptes”.
Subject to the adaptations provided for in the chapters below, the following provisions of the Code are applicable in French Polynesia: 1° Articles R. 123-220 to R. 123-34-1, insofar as they concern State institutions and departments and legal entities governed by administrative public law whose registered office is located in French Polynesia, as well as their establishments. For the application of this code in French Polynesia, the terms listed below are replaced as follows: 1° “Tribunal judiciaire” by “tribunal de première instance”; 2° “Tribunal de commerce” or “justice consulaire” by “tribunal mixte de commerce”; 3° “Conseil de prud’hommes” by “tribunal du travail”; 4° “Département” or “arrondissement” by “Polynésie française”; 6° “Préfet” or “sous-préfet” by “représentant de l’Etat en Polynésie française”.
For the application of Article L. 610-1, the seat and jurisdiction of the commercial courts with jurisdiction in French Polynesia shall be determined in accordance with the tables in Annexes 9-2 and 9-3 to this code.
In article R. 721-2, the words: “in the table in appendix 7-1 of this book” are replaced by the words: “in the table in appendix 9-1 of this book”.
In Article R. 721-3, the words: “and the number of chambers of each commercial court” are replaced by the words: “of the mixed commercial court of Papeete”, and the words: “in the tables in Annex 7-2 to this Book” are replaced by the words: “in the table in Annex 9-1 to this Book”.
For the application of Chapter III of Title II of Book VII, the following provisions are added: “The general election of judges of the mixed commercial courts takes place in the first fortnight of October. “
