Advertisements for and job offers from one or more temporary employment agencies must expressly mention their name and their status as a temporary employment agency.
In the case of an anonymous offer, the administrative authority and the departments of the institution mentioned in article L. 5312-1 may, on simple request, obtain from the director of the publication or the person responsible for the means of communication the name or company name and address of the employer. This information may be used to inform potential candidates for the job offer published or broadcast.
Decrees in the Conseil d’Etat shall determine the conditions for the application of this chapter, in particular the conditions for the use of nominative information that bodies carrying out investment activities may request, hold, retain, disseminate and transfer for the purposes of this activity.
Competition, consumer affairs and fraud control officers are empowered to investigate and record, under the conditions set out inarticle L. 511-5 of the Consumer Code: 1° Infringements of the provisions of article L. 5331-3 ; 2° Infringements of the provisions of article L. 5331-5.
Decrees in the Conseil d’Etat shall determine the conditions of application of this chapter.
The act of inserting an offer of employment or an offer of work at home, in disregard of the provisions of article L. 5331-3, is punishable by one year’s imprisonment and a fine of 37,500 euros. A jobseeker is anyone who is looking for work and applies to Pôle emploi to be registered on the list of jobseekers.
Jobseekers must periodically renew their registration in accordance with the procedures laid down by order of the Minister for Employment and the category in which they have been registered. They must also inform Pôle emploi of any changes in their situation that are likely to affect their registration as jobseekers.
Persons registered on the jobseekers’ list are classified in categories determined by order of the Minister for Employment on the basis of the purpose of their application and their availability for employment.
When a foreign person is registered on the list of jobseekers, Pôle emploi checks the validity of their residence and work permits. Pôle emploi may have access to the files of State services to obtain the information required for this verification, including when renewing residence and work permits, in order to ensure that the person concerned remains on the list of jobseekers.
