Validation of prior experience is awarded by a panel, the composition and operating procedures of which are set by decree.
Validation of acquired experience can only be carried out with the employee’s consent.
An employee’s refusal to agree to a validation of acquired experience is neither a fault nor grounds for dismissal.
The information requested from the beneficiary of an action to validate prior learning has a direct and necessary link with the purpose of the validation as defined in article L. 6411-1.
Persons in possession of information provided by candidates in connection with their validation applications are subject to the provisions of articles 226-13 and 226-14 of the French Penal Code.
When an employee has all or part of his acquired experience validated during working time and at his own initiative, he is entitled to leave for this purpose. The employee applies to the employer for authorisation to take the leave provided for in article L. 6323-17. The employer may refuse this authorisation for service reasons, giving reasons for postponing it within a period and according to procedures defined by decree.
The duration of this leave may not exceed forty-eight hours per assessment session. This period may be increased by collective agreement.
The hours devoted to the validation of acquired experience benefiting from the authorisation provided for in article L. 6422-1 constitute actual working time and give rise to the maintenance of the employee’s remuneration and social protection in accordance with articles L. 6323-18 and L. 6323-19 and by way of derogation from article L. 6323-17-5.
The costs of measures to validate acquired experience include the procedural and support costs determined by regulation.
The grounds for refusal of requests to cover the costs mentioned in article L. 6422-4 are determined by regulation.
