Any person operating a modelling agency who fails to provide a financial guarantee, in breach of the provisions of article L. 7123-19, is liable to six months’ imprisonment and a fine of 75,000 euros.
Any person operating a modelling agency who fails to provide a financial guarantee resulting from a guarantee given in breach of the provisions of article L. 7123-20 is liable to six months’ imprisonment and a fine of 75,000 euros.
Where the financial guarantee provided for in article L. 7123-19 is insufficient, failure by any user to take the place of the modelling agency for the payment of sums still due to employees and social security bodies, in disregard of the provisions of article L. 7123-21, is punishable by six months’ imprisonment and a fine of 75,000 euros.
Any person operating a modelling agency who fails to provide the user, at his or her request, with a certificate from the social security bodies, in breach of the provisions of article L. 7123-22, is punishable by six months’ imprisonment and a fine of 75,000 euros.
A child under the age of sixteen may not, without prior individual authorisation granted by the administrative authority, be engaged or produced in any capacity whatsoever: 1° In a sedentary or touring entertainment company; 2° In a cinema, radio, television, sound recording or audiovisual recording company, whatever the means of communication to the public; 3° In order to work as a model within the meaning of article L. 7123-2 ;…
The employment of a minor over the age of thirteen, with a view to carrying out the activities defined in article L. 7124-1, is subject to their written approval.
The individual authorisation to employ a child referred to in article L. 7124-1 may be withdrawn at any time.
Individual authorisation is not required if the child is hired by a modelling agency operating under the conditions set out in article L. 7123-11 and which has obtained authorisation to hire children.
When the child is engaged, in application of 5° of article L. 7124-1, the individual authorisation takes the form of an agreement.
The approvals provided for in articles L. 7124-4 and L. 7124-4-1 for the employment of children under the age of sixteen are granted by the administrative authority for a fixed renewable period. They may be withdrawn at any time. In an emergency, they may be suspended for a limited period.
