The employment and selection of a child, whether at school or not, working as a model may not exceed the maximum daily and weekly periods determined by decree in the Conseil d’Etat.
The employment and selection of an out-of-school child working as a model may only be authorised for two days a week, excluding Sundays.
During school periods, the employment of a schoolchild as a model and the preliminary selection for this activity may only be authorised on weekly rest days other than Sunday.
A portion of the remuneration received by the child may be left at the disposal of his or her legal representatives. The remainder, known as the “pécule”, is paid to the Caisse des Dépôts et Consignations and managed by the Caisse until the child reaches the age of majority or becomes legally independent. Withdrawals may be authorised in emergencies and on an exceptional basis.
When, pursuant to articles L. 7124-4 and L. 7124-4-1, the employment of a child is not subject to authorisation, the rules for dividing the remuneration received by this child between his legal representatives and the allowance are set by the authorisation decision provided for in article L. 7124-5. Deductions from the allowance may be authorised under the conditions set out in the second paragraph of article L. 7124-9.
The remuneration to which the child is entitled in the event of use of his or her image pursuant to article L. 7123-6 is subject to the provisions of this sub-section.
Remuneration of any kind received by children aged sixteen and under for performing an artistic or literary activity, other than those mentioned in article L. 7124-1, are subject to the provisions of this sub-section.
It is forbidden for any person to publish, by any means, comments, information or intelligence about minors engaged or produced under the conditions set out in articles L. 7124-1 and L. 7124-4, other than that concerning their artistic creation.
All abusive advertising aimed at attracting minors to artistic professions, the lucrative nature of which is emphasised, is prohibited.
Written advertising offering modelling work to children under the age of sixteen may only come from modelling agencies that are licensed to employ children under the age of sixteen.
