The rules for preventing risks to the health and safety of workers exposed to noise are determined by a decree of the Conseil d’Etat issued pursuant to Article L. 4111-6.
The rules for preventing risks to the health and safety of workers exposed to mechanical vibrations are determined by a decree of the Conseil d’Etat issued pursuant to Article L. 4111-6.
The rules for preventing risks to the health and safety of workers, including self-employed workers and employers, exposed to ionising radiation are laid down in compliance with the general principles of personal radiation protection set out in Articles L. 1333-2 and L. 1333-3 of the Public Health Code, without prejudice to the general principles of prevention set out in Article L. 4121-2 of this Code.
As an exception toarticle 226-13 of the French Penal Code, the occupational health physician may communicate to the person appointed by the employer to advise him/her on the radiation protection of workers any items or information covered by confidentiality, as long as their transmission is limited to that which is strictly necessary for the performance of his/her duties.
The person appointed by the employer to advise on the radiation protection of workers is bound by professional secrecy under the penalties and conditions set out in articles 226-13 and 226-14 of the French Penal Code, with regard to data covered by secrecy which has been communicated to him by the occupational physician in application of article L. 4451-2.
The rules of prevention called for by this chapter are determined by decree of the Conseil d’Etat issued pursuant to Article L. 4111-6, in particular the specific and adapted medical monitoring arrangements for workers exposed to ionising radiation, in particular for the workers mentioned in Article L. 4511-1.
The rules for preventing risks to the health and safety of workers exposed to electromagnetic fields are determined by a decree of the Conseil d’Etat issued in application of article L. 4111-6. This decree complies with the prevention principles laid down in articles L. 4121-1 and L. 4121-2.
Notwithstanding Articles L. 1111-2 and L. 1111-3, for the application of Chapter I of Title VI of Book IV of Part IV of the regulatory part, a decree in the Conseil d’Etat sets the conditions under which the number of employees and the rules for crossing workforce thresholds are determined.
The rules for preventing risks to the health and safety of workers arising from work carried out in an establishment by an external company are determined by decree of the Conseil d’Etat, pursuant to Articles L. 4111-6 and L. 4611-8.
