Any advice given to a young person on access to modelling is free of charge.
Expenses advanced by the modelling agency for the promotion and development of the model’s career may only be reimbursed by means of successive deductions not exceeding a percentage of the amount of wages and remuneration payable. This percentage is determined by decree of the Conseil d’Etat.
An employee with an employment contract with a modelling agency is entitled to an indemnity in lieu of paid leave for each assignment, regardless of the duration of the assignment. The amount of the indemnity, calculated on the basis of this duration, may not be less than one tenth of the total remuneration due to the employee. The allowance is paid at the end of the service.
Models may be placed for remuneration. Any person established on national territory who carries out the activity defined in the first paragraph must hold a modelling agency licence. Model agencies legally established in another Member State of the European Union or party to the Agreement on the European Economic Area may carry out this activity on a temporary and occasional basis on national territory, provided they have declared their activity…
Any natural or legal person whose activity consists of making models temporarily available to users, for consideration, is deemed to be operating a modelling agency if it hires and remunerates models for this purpose.
The provisions relating to unlawful lending of labour set out in Article L. 8241-1 do not apply to the activity of operating a modelling agency when this is carried out by a person carrying out the activity of modelling agency under the conditions set out in Article L. 7123-11.
The issue of a model agency licence by the administrative authority is subject to conditions determined by regulation. When a modelling agency makes a model available to a user, a contract for the provision of a model is concluded in writing between the user and the agency. This contract specifies the characteristics of the service required of the model. A copy of the contract is given to the model by the agency before he or she accepts the proposed assignment.
