Any person who has made false statements in order to be or remain registered on the jobseekers’ list will be removed from the list, under conditions determined by a decree of the Conseil d’Etat.
Making false statements or providing false information in order to be or remain registered on the list of jobseekers referred to in Article L. 5411-1 is punishable by the penalties set out in Article 441-6 of the Criminal Code.
In addition to measures designed to facilitate their redeployment or conversion, persons who are fit for work and seeking employment are entitled to a replacement income under the conditions set out in this Title.
Replacement income takes the form of: 1° An insurance allowance, as provided for in Chapter II of this Title; 2° Solidarity allowances, as provided for in Chapter III; 3° An allowance for self-employed workers and other allowances and indemnities governed by special schemes, as provided for in Chapter IV.
The condition of seeking employment required to benefit from a replacement income is met if the persons concerned are registered as jobseekers and carry out, on their own initiative or at the suggestion of one of the organisations mentioned in article L. 5311-2, positive and repeated acts with a view to finding a job or setting up, taking over or developing a business. The insurance allowance is granted for limited periods that take into account the age of the persons concerned and their previous professional activity. These periods may also take into account any training undertaken by the persons concerned. They may not be less than the periods determined by decree of the Conseil d’Etat.
Unexhausted rights to insurance benefit from previous periods of compensation are taken into account, in whole or in part, in the calculation of the duration and amount of rights when a new period of compensation is opened, under the conditions defined in the unemployment insurance agreements referred to in article L. 5422-20.
