When the deadlines set by the client for delivery of the work require the homeworker to extend his activity beyond eight hours per working day, the rate for performance shall be increased, unless a collective labour agreement or arrangement stipulates otherwise: 1° by at least 25% for the first two hours worked ; 2° By at least 50% for the following hours. When the client gives a job to be delivered by a deadline such that it can only be completed by working on a Sunday or public holiday, the worker will be entitled to the supplements provided for in the applicable collective labour agreement for work performed on the weekly rest day or public holidays.
Workshop costs, in particular rent, heating and lighting of the work premises, motive power, normal depreciation of the means of production, as well as ancillary costs, are determined by the administrative authority in accordance with the procedure defined in article L. 7422-6.
The value of raw materials and ancillary supplies that the homeworker is required to obtain in whole or in part is not included in the rate and is reimbursed separately. Where the worker is required to obtain the ancillary supplies from the employer, they will be provided free of charge.
Claims by homeworkers relating to the rate for work performed, workshop expenses, incidental expenses and paid holidays shall be barred after five years from the date of payment of their wages.
Trade unions may bring any civil action based on non-compliance with the provisions of this Book. They may bring such actions on behalf of each of their members, without having to provide evidence of a mandate from the interested party, provided that the latter has been notified and has not declared his opposition. The person concerned may always intervene in proceedings brought by the union.
The administrative authority may determine the categories of work presenting risks to the health and safety of workers, which may only be carried out by homeworkers under the conditions laid down in this chapter.
Employers who have work carried out in the home falling into one of the categories provided for in Article L. 7424-1 are responsible for applying to home workers and the auxiliaries they employ the individual protection measures provided for by the provisions of the decrees mentioned in Article L. 4111-6.
When a homeworker and any of his assistants carrying out the work referred to in Article L. 7424-1 are employed under conditions that do not comply with health and safety at work obligations, the Labour Inspectorate monitoring officer referred to in Article L. 8112-1 may give the client formal notice to cease using the services of this worker.
The general provisions of article L. 1511-1 also apply to the provisions of this book.
