An equal number of employer and employee substitutes are appointed under the same conditions as the full members. They sit only in the absence of the full members. If the chairman is unable to attend, he is replaced by one of the representatives of the Minister of Justice.

Article R1431-8 of the French Labour Code

The Chairman and the full and alternate representatives of employers and employees are appointed by joint order of the Minister of Justice and the Minister of Labour, for a renewable term of four years. Article R1431-9 of the French Labour Code

The duties of a member of the Conseil supérieur de la prud’homie are not remunerated. Travel and subsistence expenses incurred by the members of the Council and the persons mentioned in article R. 1431-16 may give rise to reimbursement. This reimbursement is made under the conditions set by joint order of the Minister of Justice, the Minister of Labour and the Minister of the Budget.
